FAQ - DD 149

What is the purpose of DD 149?
This issue relates to the classification of DD 149, which contains an order granting a permanent stay in proceedings in relation to copyright infringement of a film by the accused, in relation to a publication of the film in The Guardian dated May 8, 2010. This case relates to the publication of a copy of the “The Pirate Bay” website as part of The Guardian's online magazine The Intercept, in September 2009. The “The Pirate Bay” website, which is hosted in Sweden, has been the subject of a number of copyright protection issues in the US. In this case against The Guardian, the Court found that a copy or copies of the website were made by the accused under the authorization of a domain manager, and this copy or copies were disseminated or reproduced on The Guardian's website (including in articles published on the article's page) without the authorization of the domain manager. This resulted in the making of a copy or copies of the website or infringing copies of the website, infringing copies of which were distributed or reproduced on the internet by the accused. What evidence is adduced? The accused argues that the court, by applying an “expertise” on the Internet, should be made aware that the accused would likely use the websites described in these paragraphs to infringe the copyright in The Pirate Bay, which is protected by S.1201 of the US Copyright Act. According to the accused, The Pirate Bay is a website owned and operated by Swedish citizen Carl Angstrom, but operated worldwide by a co-founder of the anti-copyright group The Pirate Bay Limited, and he's located in Iceland. The sites' purpose and nature, including access, is as described by The Pirate Bay Limited, and Angstrom's ownership and administration of these sites is documented in the IPC's Statement of Claim. The following is a summary of some of the facts that are the basis for the “expertise” argued by the accused against this issue, in an effort to persuade this court that the Internet is incapable of meeting the definition of 'expertise': 1. The Internet's function is to enable communication and collaboration. To create, modify and distribute a work means to share the work. The Internet is not just a communication tool. It also enables other types of collaboration. Such other types of collaborative activity are not limited to the creative process.
